Nicholas Akerberg, 28, of Yarmouth Port, is accused of showing up at the courthouse around 10:30 a.m. Monday, April 14, looking ready for battle, the Middlesex District Attorney's Office said. Authorities say he ignored commands and pushed his way through the lobby, where he then unleashed pepper spray on multiple people — including a Stoneham police officer and an assistant district attorney.
Officials said Akerberg also punched and shoved several individuals during the attack. Officers used a Taser to bring him under control and place him under arrest. Investigators later found eight pepper spray canisters and two smoke devices in his possession.
Akerberg is facing a long list of charges, including:
- Six counts of assault and battery with a dangerous weapon
- Five counts of assault and battery on a public employee
- Two counts of assault and battery on a police officer
- Disrupting a court proceeding, bomb threat, and intimidation
He, along with the police officer and two court officers, were taken to a hospital and have since been released.
During his court appearance, Akerberg was ordered held while he awaits a dangerousness hearing. The judge also revoked his bail on other open cases and ordered a mental health evaluation. His next court date is scheduled for May 2.
Officials are condemning the incident as more than just a violent outburst. “Today’s assault was the third serious incident at a courthouse since March 10, 2025. These are not just acts of violence, they are challenges to the rule of law and to peaceful, orderly dispute resolution,” said one official.
“Courts are sacred, hallowed places... Anyone who desecrates these sacred places will be prosecuted to the fullest extent of the law,” the statement continued.
